Privacy Policy

Privacy policy of the Wiener Hofmusikkapelle according to art. 13 GDPR

Responsible handling of personal data is a matter of course for the Wiener Hofmusikkapelle as a subordinate department of the Federal Ministry of Art, Culture, Public Service and Sports. Due to the further development of our websites and the implementation of new technologies, it may become necessary to update the data protection declaration. We therefore recommend that you read this data protection declaration regularly.

 Legal basis Data protection

  • The website of the Wiener Hofmusikkapelle processes data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (Basic Data Protection Regulation, GDPR) and the Data Protection Act, Federal Law Gazette I no. 165/1999, as amended.
  • The Wiener Hofmusikkapelle is "responsible" in the sense of the GDPR for the data collected from users.

Serverlogs

Each of your accesses to the website of the Wiener Hofmusikkapelle is stored in a log file (server logs) for a limited period of 1 year with the following data:

  • Pseudonymized IP address of the requesting party (the last two digits of the IP address are shortened)
  • Request details and destination address
  • Name of the retrieved file and amount of data transferred
  • Date and time of retrieval
  • Message whether the retrieval was successful
  • Processing time of the request in microseconds
  • Browser make, version and operating system
  • Referrer
  • Version of the http protocol used
  • http status code, which provides information about successful response, forwarding or error
  • Data volume of the request and the retrieval

Purpose

This data is used exclusively for checking the system security. There is no personal evaluation or profile creation.

Legal basis

The lawfulness of data processing is based on Art. 6 para. 1 lit. f GDPR: The processing serves to secure the legitimate interests of the data controller.

Provision of data

The provision of personal data for the purpose is not required by law or contract. It is possible to not provide said information by not visiting the site.

Recipient categories

If necessary, third parties commissioned by the Wiener Hofmusikkapelle. There will be no personal evaluation or profile creation. Nevertheless, we reserve the right to evaluate your IP address in case of attacks on the internet infrastructure of the department. In case of suspicion of a criminal offence, the data must be transmitted to the criminal prosecution authorities in accordance with the applicable regulations.

Storage duration

The data and information remain on the website as long as this is necessary for the respective purpose or is contractually agreed. In the event that consent is the basis for processing, as long as the consent is not revoked.

Notice concerning the rights of the parties concerned

Of the rights of the data subject, in cases where data processing is carried out on the basis of Art. 6 Paragraph 1 lit. a or b GDPR, the right of objection pursuant to Art. 21 GDPR does not apply. Art. 6 Para. 1 letter f GDPR takes place, the rights to deletion and data transfer pursuant to Art. 17 and 20 GDPR do not apply.

E-mailing, orders and other contacts

Data that you provide by e-mail (e.g. registration for events, input on questions) will be handled responsibly by our employees.

The possibility of providing your contact details, your consent to the processing of the data and information on your rights under the GDPR, including the right to revoke your consent, can be found in the respective service offer. If you give your consent, your data will only be used for the respective purpose for which you have made them available. The data will be stored as long as they are required for this purpose and you have not revoked your consent to data processing.

The website of the Wiener Hofmusikkapelle does not use cookies.

Processing of personal data on the website

The Webalizer Xtended tool is used on the website of the Wiener Hofmusikkapelle for the purpose of analysing user behaviour. The analysis of user behaviour is important, so that the demand for content can be analysed and the online offer can be optimised. The collected user data is not used to create user profiles.

The "Webalizer Xtended" tool only collects statistical data, such as the most frequently visited website content, the most frequently used browsers, the countries from which most queries originate. The most frequent links used by visitors to reach the Hofmusikkapelle website and the most frequent entry and exit pages are recorded in tabular form.

In the version we use, the "Webalizer Xtended" tool works with the pseudonymised IP address. For this, the last two digits of the IP address are set to 0. For IPv4 addresses, this concerns the last 8 bits, for IPv6 addresses the last 80 bits.

The data records are stored on our web server and evaluated in-house exclusively for statistical purposes. At no time will this data be passed on to third parties. The tool "Webalizer Xtended" does not use cookies.

Legal basis for the data processing

The legal basis for data processing using "Webalizer Xtended" in the described form is article 6 paragraph 1 letter f GDPR.

Purpose of the data processing

Through the "Webalizer Xtended" tool, we learn how the website is used and can thus continuously optimize our online offer. This is also our legitimate interest in the processing of personal data in accordance with Art. 6 para. 1 lit. f GDPR.

Duration of storage

The stored statistical information is deleted by us after one year at the latest.

Possibility of objection and removal

The user can object to the storage of this information by sending a message to office@hofmusikkapelle.gv.at.

Publication of information containing personal data

Personal data (in particular names) are published on the website of the Wiener Hofmusikkapelle (e.g. members of the ensemble, contact persons for various topics, participants in events, recipients of awards and prizes) for the purpose of contact and networking information or documentation.

Purpose

Public relations work of the Wiener Hofmusikkapelle.

Legal basis

The lawfulness of the processing is justified,

  • if the consent of the person concerned has been obtained for publication, to Art. 6 para. 1 lit. a GDPR: the data subject has consented to the processing of the data for the purpose
  • if publication is made on a contractual basis, to Art. 6 para. 1 lit. b GDPR: the processing is necessary for the performance of a contract to which the data subject is party or for the performance of pre-contractual measures taken at the request of the data subject
  • otherwise, on Art. 6 para. 1 lit. f GDPR: protection of the legitimate interests of the controller or a third party is required.

Provision of data

The provision of personal data is not required by law, it may be required by contract. Failure to provide it would mean that the personal data could not be used to inform the public.

The data will not be transmitted. They are accessible to the visitors of the website. If necessary, processors of the department have access to the data.

No personal user profiles are created.

Storage duration

Without prejudice to any information provided on the applications, we would like to point out that your data will be deleted as soon as they are no longer required or one of the other deletion conditions according to Art. 17 GDPR applies. Your other enquiries to the Wiener Hofmusikkapelle will be kept in paper or electronic form in accordance with the periods applicable to the storage of written material. Your data will be used exclusively for direct correspondence with you.

Transmission of personal data to third parties

Apart from that, data, as far as and as long as they are personally processed within the framework of the website or the service offers mentioned, will be transmitted to third parties exclusively within the framework of legal obligations, e.g. if this becomes necessary due to a court decision or in case of attacks on the Internet infrastructure for legal or criminal prosecution.

Protection of minors

Persons under 14 years of age should not transmit personal data to us without the consent of their parents or legal guardians. We do not request personal data from children and young people. We do not knowingly collect such data and do not pass them on to third parties.

In the case of an offer of information society services made directly to a child, consent pursuant to Art. 6 para. 1 lit. a DSGVO to the processing of the child's personal data is lawful if the child has reached the age of fourteen.

Links to websites of other providers

Our online offer contains links to websites of other providers. We have no influence on whether these providers comply with the data protection regulations.

Your rights

Reference to data subjects' rights

You are basically entitled to the rights of information, correction, deletion, restriction, data transferability, revocation and objection. If you believe that the processing of your data violates data protection law or your data protection rights have otherwise been violated in any way, you can complain to the supervisory authority. In Austria this is the data protection authority.

You can exercise the following rights to which you are entitled under the General Data Protection Regulation by means of an informal application to the Wiener Hofmusikkapelle:

  • You have the right of access, i.e. you can request confirmation as to whether data relating to you are being processed. If this is the case, you have the right to be informed about the personal data processed (art. 15 GDPR).
  • If the data relating to you are processed incorrectly, you have the right to ask for rectification. If you discover that the data are being processed incompletely, you have the right to request that the data be completed (Art. 16 GDPR).
  • You have the right to request that data relating to you be deleted immediately (Art. 17 DPA); this request must be complied with if the conditions laid down in this provision are met.
  • In the event that, for economic or technical reasons, the correction or deletion can only be carried out at specific times, the processing of the data concerned must be restricted until the correction or deletion (Art. 4 para. 2 Data Protection Act). Restriction of processing means that the data relating to your person, apart from storage, may only be further processed with your consent or for specific reasons regulated by law.
  • You have the right to request the restriction of the processing of your data if you
    1. contest the accuracy of your processed data and request an examination of your submission by the Wiener Hofmusikkapelle
    2. give preference to the restriction of data processing instead of the right to delete unlawfully processed data,
    3. need the data for your legal claims and therefore do not want the Wiener Hofmusikkapelle to delete them, although it no longer needs them for the purposes for which they were collected (Art. 18 GDPR)

The exercise of these rights is free of charge for you.

However, in the case of manifestly unfounded or - especially in the case of frequent repetition - excessive requests, an appropriate fee may be charged, taking into account administrative costs, or you may refrain from processing your request.

Complaint to the data protection supervisory authority

You have the right to complain to the data protection supervisory authority - in Austria this is the data protection authority - if you believe that the processing of data relating to your person violates the basic data protection regulation (Art. 77 GDPR).

Responsible body

The Wiener Hofmusikkapelle decides on the above-mentioned purposes and the means of data processing and is therefore the responsible party in terms of Art. 4 Z 7 GDPR.
